By accessing or using the website at masonrybend.com ("the Site") or by requesting, scheduling, or receiving services from Advanced Bend Concrete & Masonry ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Site or our services.
These Terms may be updated at any time. Continued use of the Site or our services after any update constitutes your acceptance of the revised Terms. The most current version is always available at masonrybend.com/terms-and-conditions.
Advanced Bend Concrete & Masonry is a masonry contractor based in Bend, OR. We provide residential and commercial masonry services including, but not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, driveway pavers, walkway construction, and related work in Central Oregon.
The Site is an informational resource. Content on the Site describes general services and is not a binding offer to perform any specific scope of work at any specific price. All service agreements are established through a separate written estimate and, if accepted, a project agreement signed by both parties.
All estimates provided by Advanced Bend Concrete & Masonry are based on an on-site assessment of the property and the described scope of work at the time of the estimate. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
Estimates may be subject to revision if site conditions differ materially from those present at the time of assessment, if the project scope changes at the customer's request, or if unforeseen conditions are discovered during the work. We will notify you before proceeding with any work that exceeds the original estimate.
No work will begin until a written estimate has been provided and accepted by the customer. Verbal price quotes are informational only and are not binding.
Appointments for estimates and project work are scheduled based on crew availability. We will provide you with a confirmed appointment date and a reasonable estimated start time. We will notify you as promptly as possible if we need to reschedule due to weather, crew availability, or other circumstances outside our control.
Customers who need to cancel or reschedule a confirmed appointment should provide at least 24 hours' notice. Cancellations or no-shows after project work has begun may result in charges for materials already ordered or work already performed.
Outdoor masonry work may be delayed or suspended due to inclement weather, extreme temperatures, or other conditions that could affect the quality of the work. We will communicate any such delays and reschedule as quickly as conditions allow.
Payment terms are specified in the written project agreement. In general, a deposit may be required before work begins to cover materials, and the remaining balance is due upon satisfactory completion of the work. Accepted payment methods will be stated in the project agreement.
Invoices not paid within the time period stated in the project agreement may be subject to a late fee. If collection efforts become necessary, you agree to reimburse us for reasonable costs of collection, including attorney fees, to the extent permitted by applicable law.
Advanced Bend Concrete & Masonry warrants that all work will be performed in a workmanlike manner consistent with applicable industry standards. Any specific warranty terms - including duration and scope - will be stated in the written project agreement for that job.
Warranty coverage does not apply to damage caused by events outside our control after project completion, including but not limited to natural disasters, ground movement unrelated to our work, freeze-thaw cycles acting on pre-existing conditions, improper maintenance by the property owner, or modifications made to our work by others.
The Site itself - including all information, text, and other content - is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, Advanced Bend Concrete & Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to our services or the use of the Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a specific project shall not exceed the total amount paid by you to us for that project.
We prefer to resolve any disputes directly. If you have a concern about the quality of work or any other aspect of our services, contact us first at support@masonrybend.com or (458) 256-4347 and give us a reasonable opportunity to address it.
If a dispute cannot be resolved directly, both parties agree to first attempt resolution through a mutually agreed-upon mediator before pursuing litigation. This provision does not prevent either party from seeking emergency injunctive relief in court where necessary to prevent irreparable harm.
These Terms and Conditions are governed by the laws of the State of Oregon, without regard to its conflict-of-law provisions. Any legal action or proceeding arising out of these Terms or our services shall be brought exclusively in the state or federal courts located in Oregon.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable law, infringes on the rights of others, or interferes with the Site's operation. We reserve the right to restrict or terminate access to the Site at any time for any reason without notice.
All content on the Site - including text, images, and the Advanced Bend Concrete & Masonry name and logo - is owned by or licensed to us and may not be copied, reproduced, or used without our written permission.
We reserve the right to update these Terms at any time. When we do, we will revise the Effective Date at the top of this page. If you use the Site or our services after a revision, you have accepted the updated Terms. We encourage you to review this page periodically.
